Terms of Service

By accessing or using Call Santa Live (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service.

The Service is operated by DigitEyes Consulting LLC, a limited liability company organized under the laws of the State of Wyoming, USA (“we,” “our,” or “us”).

Call Santa Live offers live, interactive “Santa Call” experiences and related digital features such as wishlists, letters, and messages. These experiences are designed for entertainment and family enjoyment only.

Disclosure: Santa Call experiences are powered by advanced AI technologies and real-time digital rendering. The Santa character is a simulated, AI-assisted representation and not a live human performer.

These features are not intended to provide advice, guidance, emotional support, or emergency assistance of any kind.

  • All purchases must be made by a parent or legal guardian (“Parent”).
  • Children may participate only with parental consent and direct supervision.
  • Parents are fully responsible for their child’s participation and safety during use.
  • You agree to maintain the security of your account and be responsible for all activity under it.
  • Children under 13 may only use the Service with a supervising Parent present.

We offer a 90 second Free Preview Mode that allows families to experience a live Santa interaction without making a purchase.

During the preview, audio and video are processed only in real time to deliver the interactive session. No recordings are made, and we do not store, save, or retain any audio, video, or preview interactions.

Parents must supervise all child participation. By starting the preview, you consent to temporary processing of audio and video solely for providing the real-time experience.

We may limit the frequency or availability of the Free Preview Mode at our discretion.

The Service operates on a pay-as-you-go basis. You may purchase Santa Call Credits or individual sessions. There are no recurring subscriptions or automatic renewals.

  • Prices and taxes are displayed at checkout.
  • Payments are processed securely through trusted third-party providers.
  • All sales are final.
  • Credit Expiry: All Santa Call Credits automatically expire at the end of each calendar year (December 31st), unless required by law to remain valid longer.
  • You are responsible for ensuring your device and internet connection meet technical requirements.

Every Santa Call is a one-of-a-kind live experience, created specifically for your family. Because of this, all purchases are final and non-refundable.

If a technical problem occurs on our side (such as a duplicate charge or confirmed system failure), please contact us and we will resolve the issue.

To keep the experience positive and safe, you agree not to:

  • Upload, say, or transmit illegal, harmful, or inappropriate content.
  • Attempt to manipulate, jailbreak, confuse, or exploit the AI Santa character.
  • Harass, impersonate, or harm others.
  • Attempt to disrupt, hack, or reverse-engineer any part of the Service.
  • Use the Service for emergency, crisis, therapeutic, or behavioral support purposes.

We may monitor for abuse (without recording video sessions) and suspend or terminate access for violations.

We reserve the right to suspend or close any account, or refuse access, at our sole discretion and without obligation to provide a reason.

Accounts involved in fraud, payment disputes, or chargeback abuse may be permanently closed.

  • We do not record or store video or audio from Santa Calls.
  • We may retain limited technical logs (never video/audio) to ensure performance and safety.
  • Personal data is handled according to our Privacy Policy.
  • Parents control what information is shared during the experience.
  • We never sell or trade personal information.

All content, artwork, characters, voice, video, branding, and code are the property of DigitEyes Consulting LLC or its licensors. You receive a limited, personal, non-transferable license to use the Service for family entertainment only.

Marketing examples are demonstrations only. Actual Santa Call experiences may vary based on user input, AI interpretation, and system conditions.

If you provide ideas, suggestions, or feedback, you agree we may use them freely without compensation.

If you submit wishlists, names, or other materials (“User Content”), you grant us a limited license to use that content solely for operating and improving the Service.

We may modify, suspend, or discontinue parts of the Service at any time. While we aim to minimize disruption, availability is not guaranteed.

Live video performance may depend on your device, internet connection, and third-party platform stability. We are not responsible for interruptions caused by factors outside our control.

The Service may rely on third-party platforms for video, audio, AI, or payments. Use of those services is subject to their own terms and policies. We are not responsible for their availability or performance.

We are not liable for any delay or failure caused by events outside our reasonable control, including natural disasters, power or network outages, strikes, service provider failures, or acts of government.

The Service is provided “as is” and “as available.” We make no warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

AI systems may misunderstand speech, misinterpret input, or produce unexpected responses. This is normal and not a defect.

To the fullest extent permitted by law, our total liability for any claim shall not exceed the amount you paid for the affected Santa Call or Credits.

We are not liable for indirect, incidental, special, or consequential damages, including emotional distress, data loss, or interruptions.

You agree to indemnify and hold harmless DigitEyes Consulting LLC, its members, contractors, and affiliates from any claims, damages, or expenses (including reasonable legal fees) arising out of your misuse of the Service.

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Any dispute shall be brought exclusively in the state or federal courts located in Wyoming, and you consent to jurisdiction in those courts.

You are responsible for ensuring that your use of the Service complies with local laws. If use of the Service is prohibited in your country, please do not use it.

If any provision of these Terms is found unenforceable, the rest remain in effect. These Terms constitute the entire agreement between you and DigitEyes Consulting LLC regarding the Service.
